Terms & Conditions

Clear, professional terms presented in a premium format consistent with the PS Media Entertainment brand.

Note: For the purposes of this document, PS MEDIA ENTERTAINMENT shall be referred to as PSM. Any visitor to the site, individual, or organisation engaging PSM for an assignment, or ordering images or video content, shall be referred to as The Client.

Applicable Law

a) This agreement shall be governed by the laws of England and Wales. These Terms and Conditions may only be varied by written agreement.

b) In the event of any conflict between these Terms and Conditions and any terms issued or submitted by The Client, these Terms and Conditions shall prevail unless otherwise agreed in writing.

Booking Fee / Session Fee

a) By booking with PSM, The Client enters into a contract and agrees to abide by these Terms and Conditions.

b) Booking fees for any session or assignment, including events, portraits, and commercial work, are non-refundable, except where PSM cancels the booking or, at its discretion, agrees otherwise in exceptional and unavoidable circumstances.

Images Online

a) It is illegal to download, copy, alter, or attempt to remove a watermark from any image published online by PSM without prior written permission.

b) If any image is saved, reproduced, or used elsewhere without the written permission of PSM, a copyright infringement fee of £1000.00 per image shall apply and must be paid within 28 days to avoid legal action.

Fulfilment of Obligations

a) PSM shall not be liable for any failure, in whole or in part, to fulfil its obligations where such failure results from events or circumstances beyond its reasonable control, including but not limited to equipment failure, severe weather, illness, or injury.

b) The Client acknowledges that photographic and videographic coverage shall be delivered according to PSM’s professional judgement and expertise. Special requests are not binding, although every reasonable effort will be made to accommodate them.

c) In the event of total photographic failure, cancellation by either party, or any other circumstance giving rise to liability, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

d) If The Client fails to read or follow booking advice, and required preparations are not completed before a session, PSM shall not be responsible for any resulting reduction in the quality or quantity of images supplied.

Prints

a) All images supplied by PSM are edited on a calibrated monitor, and prints will reflect that editing standard. PSM is not responsible for variations caused by non-calibrated screens or monitors used by The Client.

b) All prices are subject to change without notice. No consideration shall be given to previous clients regarding product pricing, package availability, or session fees.

Previews / Proofs

a) While PSM will make every reasonable effort to provide more proofs than discussed, no guarantee is given as to the number of proofs produced.

Image Production & Handling

a) Unless otherwise agreed, PSM retains full artistic discretion in relation to style, location, poses, and the number of images taken.

b) PSM fully edits all images considered to meet the required technical and creative standard for delivery. Additional editing may be charged at £50.00 per image.

c) Permission to reproduce an image shall only be granted when a reproduction fee has been agreed with PSM, an invoice has been issued, and payment has been made in full.

d) In the event of unauthorised reproduction, The Client shall pay liquidated damages of £1000.00 per image, or double the standard reproduction fee for the relevant use, whichever is greater.

e) Any right to reproduce an image granted by PSM is personal to The Client and may not be assigned to any third party without prior written consent.

f) The Client shall fully indemnify PSM against any unauthorised use of an image by a third party arising from any breach of these Terms and Conditions.

Identification

a) While PSM takes reasonable care to correctly identify, caption, and orientate images, it accepts no liability for loss or damage caused by errors.

Receipt of Pictures

a) Images and products shall be deemed to have been received in good condition unless The Client notifies PSM in writing of any discrepancy or error within 7 days of receipt.

Cooling Off Period

a) As photographs and related products are created to The Client’s personal specification, The Client does not have the right to a cooling-off period.

b) By placing an order with PSM, The Client commits to purchasing the ordered products.

Returns Policy

a) Incorrectly supplied items and items of unsatisfactory quality may be returned and replaced at no additional cost to The Client.

b) Returns will not be accepted for incorrectly ordered items or items ordered in error by The Client.

c) No return, exchange, or refund shall be available once image proofs have been approved and an order has been placed.

Use of Pictures

a) PSM retains the right in all cases to use images at any time, worldwide, for the purpose of advertising, sales, or promotion of its work.

Model Release

a) Unless expressly confirmed in writing, PSM makes no representation or warranty regarding the existence or validity of any model release, permission, consent, or trademark clearance connected with any image. The Client is responsible for obtaining any rights, releases, or consents required for reproduction.

Validity of Agreement

a) If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Camera Policy

a) Cameras, camera phones, camcorders, or any other recording devices are not permitted during any session, whether in the studio or on location, without the express permission of PSM.

Privacy Policy

a) PSM will never share, disclose, or permit unauthorised access to any personal or contact information obtained from any client or enquiry. All such information is stored on secure, password-protected systems.

Online Gallery Access & Image Retention

a) Where an online gallery is provided, it shall remain live for 7 days from the date the link is sent to The Client.

b) If no order is placed within that period, PSM reserves the right to charge a £20.00 administration fee to reopen the gallery.

c) Any subsequent reopening shall be charged at £25.00 per week or £50.00 per month.

d) Images are retained for a period of six months at the discretion of PS Media Entertainment.

Standard Terms of Attendance, Travel & Overtime

These terms apply to all events where PS Media Entertainment provides photography, videography, media production, or related services.

1. Attendance Duration
Coverage shall be provided for the number of hours agreed in the booking confirmation or contract. The organiser is responsible for ensuring the event schedule allows the team to perform its services within the agreed timeframe.

2. Refreshments & Meals

  • For events exceeding four continuous hours, reasonable refreshments shall be provided for the PS Media Entertainment team.
  • This should include drinking water and/or non-alcoholic beverages, tea or coffee where available, and one hot meal or equivalent per team member.
  • For events exceeding eight hours, an additional meal or substantial refreshment should be provided.
  • Where vendor catering or staff meals are available, PS Media Entertainment should be included on the same basis as other suppliers or event personnel.

3. Breaks
PS Media Entertainment reserves the right to take short operational breaks where necessary, provided these do not interfere with key scheduled moments of the event.

4. Equipment & Vendor Area
Where reasonably possible, the organiser or venue should provide a safe area for equipment storage, access to seating during breaks, and any vendor facilities ordinarily made available to production teams or service providers.

5. Travel

  • Travel within 30 miles of Kingston upon Hull is included within the standard service area.
  • For events located outside this area, a travel fee may apply to cover transportation costs and travel time.
  • Where significant travel is required, overnight accommodation may also be required and will be discussed in advance.
  • Any parking charges, congestion charges, tolls, or venue access fees shall be the responsibility of the organiser or The Client.

6. Overtime

  • If an event extends beyond the agreed coverage period, overtime may be requested subject to availability.
  • Overtime shall be charged at £175.00 per hour (or part thereof) per photographer/videographer, unless otherwise agreed in writing.
  • Overtime must be approved by The Client or an authorised representative during the event.
  • If overtime is not approved, coverage shall conclude at the originally agreed time.

7. Professional Working Environment
The organiser agrees to provide a safe, respectful, and cooperative working environment throughout the event.
